In the spring, a lone pensioner Ruchkin planted opium poppy on his plot of land among flowers and vegetables. In early summer, he was hospitalized for a long time, instructing his neighbor Somov to look after the house and stipulating that there was no need to look after the plantings. However, Somov, having discovered that a drug-containing plant was planted and is already beginning to wilt, decided to grow it until Ruchkin returned, hoping that, in gratitude, Ruchkin would share his ripened crop with him. All summer he looked after the crops, watered them, weeded, and fertilized. His calculation turned out to be correct - in the fall Ruchkin and Somov gathered a large crop of ripened poppy, halving it.
Uncover the objective and subjective signs of complicity in the crime and decide whether Ruchkin and Somov are accomplices in the crime. Argument your answer, including an analysis of the subjective relationship between partners.
From the standpoint of the doctrine of complicity, give a criminal legal assessment of the acts of each of these persons under the following options for the conditions of the task.
Option 1. Somov’s calculation turned out to be incorrect - the “ungrateful” Ruchkin, returning from the hospital and collecting a crop of poppy grown by Somov, did not share with him.
Option 2. Going to the hospital, Ruchkin told Somov about the crops, an agreement was reached between them that Somov would grow opium poppy and take the whole crop for himself.
