Kolesnikov and Mitina have been in actual marital relations since January 1944. In December 1996, they stopped living together. Kolesnikov filed a lawsuit against the division of the following property: a house bought in June 1944, a Moskvich car purchased in 1995, a garden and a summer house, a TV, a furniture set, as well as gold rings, brooches, earrings, bought by him for Mitina. In the statement of claim, the plaintiff asked to take into account that Mitina worked for no more than eight years during their life together, receiving wages about three times less than his earnings.
The respondent, in principle, not opposing the lawsuit, explained that she could not work constantly, as she raised two children and looked after the plaintiff’s sick mother. In her opinion, the plaintiff also cannot apply for a section of a garden plot and a summer house, since she is not a member of a gardening partnership.
