On May 28, 1999, the administration of the Petrovsky village of the Shchekinsky district of the Tula region made a marriage between Cherkasov and Schukina. May 31, 1999 Cherkasov died.
Abramova, Cherkasov’s mother, and his son sued Schukina in court to declare this marriage invalid. At the same time, they referred to the fact that the respondent did not intend to start a family, since Cherkasov was in a serious condition at the time of marriage, and the aim was to seize the living space and infringe on the rights of them, the plaintiffs, as heirs.
Objecting to the lawsuit, Smolina indicated that since 1990 she had been living with the same family with Cherkasov without registering a marriage, and on May 28, 1999 they decided to formalize their relationship.
