As a result of a traffic accident, the driver of a VAZZ-2104 motor vehicle, Zotkin, was inflicted light bodily injuries resulting in a short-term health disorder. Considering the driver of Sitnikov, who was driving the ZIL-130 car owned by Ural Trading Base JSC, to be the culprit, Zotkin filed a lawsuit in which he asked to recover the cost of repairing the car, taking into account the loss of the commodity cost, the services of an auto expert bureau, and compensate for the services of a lawyer - 5 thousand rubles, payment of state duty, as well as moral damage in the amount of 3 thousand rubles.
The representative of the defendant and a third party did not appear in court, although they were duly notified.
The court examined the case in the absence of the defendant and issued an absentee decision, which partially satisfied the lawsuit, both in terms of recovering the cost of repairing the car, and in terms of compensation for moral damage.
The trading base “Ural” appealed to the court with a request to review the decision in absentia 15 days after its delivery, and the plaintiff appealed the decision in absentia to the unsatisfied part.
